Introduction

These Terms of Service (the “Terms”) are entered into between you (“you”, “your”, “User”) and Info Tech Services LLC (“we”, “us”, “our”). These Terms govern your access to and use of our mobile application (the “App”).

By downloading, installing, accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

This App is not intended for children under 13 years of age. Users under 16 years old may only use the App with valid parental or legal guardian consent.

User Eligibility & User Obligations

1.1 You represent and warrant that you meet the applicable age requirement and have the legal capacity to accept these Terms.

1.2 You agree to use the App only for lawful, personal, non‑commercial purposes in accordance with all applicable local, national and international laws and regulations.

1.3 You shall be solely responsible for all activities conducted under your access to the App. You must not share your device access, authentication credentials or permissions with third parties.

1.4 You shall not:

  • Reverse‑engineer, decompile, disassemble, attempt to derive the source code of the App;
  • Modify, adapt, translate, hack, tamper with, or create derivative works based on the App;
  • Use automated scripts, bots, crawlers, scrapers to access, query or collect data from the App without our prior written consent;
  • Use the App to transmit spam, malware, harmful code, harassing, offensive, defamatory, infringing or unlawful content;
  • Interfere with, disrupt, overload or damage the App’s servers, network, security or normal operation;
  • Use the App to infringe the intellectual property rights, privacy rights or other legal rights of any third party;
  • Circumvent any access control, permission, paywall, anti‑abuse or security mechanism of the App.

1.5 You shall promptly notify us if you become aware of any unauthorised access, security breach or misuse related to your use of the App.

Intellectual Property Rights

2.1 Ownership. All intellectual property rights in and to the App, including without limitation source code, object code, software architecture, UI design, text, graphics, logos, icons, trademarks, service marks, trade dress, audio, visual assets, algorithms, documentation and all updates and modifications, are the exclusive property of Info Tech Services LLC or our licensed partners. All such rights are protected by copyright, trademark, patent, trade secret and other intellectual property laws and international treaties.

2.2 Limited License. We grant you a limited, non‑exclusive, non‑transferable, non‑sublicensable, revocable license to install and use the App solely for your personal use in accordance with these Terms. No other rights are granted to you. All rights not expressly granted are reserved by us.

2.3 Prohibited IP Use. You may not copy, reproduce, distribute, publish, display, perform, modify, transmit, sell, rent, lease or otherwise exploit our intellectual property without our prior written permission. You shall not remove, alter or obscure any copyright, trademark or proprietary notice contained within the App.

2.4 User‑Submitted Content. If you submit, upload or provide any content, materials, feedback, suggestions or ideas through the App (“User Content”), you retain ownership of your User Content. However, you grant us a worldwide, royalty‑free, perpetual, irrevocable, non‑exclusive license to use, reproduce, modify, adapt, publish and display such User Content for operating, improving and promoting the App. You warrant that you hold all necessary rights to submit such User Content and that such content does not infringe any third‑party rights.

2.5 Trademarks. The name Info Tech Services LLC, our App name, logos and brand marks may not be used in any advertising, publicity or other materials without our separate written trademark licence.

Service Availability & Modification

We reserve the right to modify, suspend, restrict or discontinue any feature or the entire App at any time, temporarily or permanently, without prior notice. We do not guarantee uninterrupted, error‑free or secure operation of the App.

Termination

We may suspend or terminate your access to the App immediately, without refund or prior notice, if we determine you have violated these Terms, including any user obligations or intellectual property restrictions. Upon termination, the limited licence granted to you automatically ends, and you must cease all use and delete all copies of the App in your possession.

Disclaimer of Warranties

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON‑INFRINGEMENT OF THIRD‑PARTY RIGHTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INFO TECH SERVICES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP.

Indemnification

You agree to defend, indemnify and hold harmless Info Tech Services LLC, its officers, employees and licensors from and against all claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your User Content, or your infringement of any intellectual property or other third‑party rights.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any dispute arising out of these Terms shall be submitted to the competent courts.

Changes to these Terms

We may update these Terms from time to time. Updated Terms will be posted within the App or on our website and take effect upon publication. Continued use of the App after publication constitutes your acceptance of the revised Terms.
